Overview

The City of Lynn seeks an Administrative Hearing Officer who can review, mitigate and adjudicate appeals filed by persons cited by the City of Lynn enforcing departments. The Hearing Officer will be responsible for reviewing, hearing, and processing all appealed citations in accordance with municipal parking ordinances, MGL Ch. 40U, building and fire code violations pursuant to MGL Ch. 148A and animal control violations pursuant to MGL Ch. 140 twice monthly as detailed in MGL Ch. 40U§14. Parking citations will be processed in accordance with MGL Ch. 90§20A. 

Duties and Responsibilities
  • Ability to hear appeals and perform administrative tasks related to the violation of city ordinances and sanitary codes in accordance to MGL Ch. 40U, MGL Ch. 90§20A, building and fire code violations pursuant to MGL Ch. 148A and animal control violations pursuant to MGL Ch. 140.
  • Scheduling appeals, drafting notices of hearings, posting meeting notices in accordance with posting requirements, conducting hearings, issuing written decisions, and participation in appeals in Land Court, District Court and Superior Court
  • The Hearing Officer processes hearing decisions; communicates decisions to proper parties in the prescribed format and timeframe.
  • Makes sound and legally defensible decisions based on the facts presented and interpretation of municipal codes and ordinances, and Massachusetts General Laws.
  • Support the City of Lynn Law Department with preparation of documents if a decision of the Municipal Hearing Officer is further appealed in accordance with the provisions of Massachusetts General Laws.
  • De-escalating difficult situations and interfacing with the general public recommended. Conflict resolution and customer service training preferred.
  • Knowledge of MUNIS, Velosum, Excel, Word and comparable software.
  • Ability to obtain Municipal Hearing Officer Certification through the Massachusetts Department of Fire Services pursuant to MGL Ch. 148A. 
  • Ability to maintain annual training pursuant to MGL Ch. 40U §14
  • Develop and make available reports on violations, appeals, decisions and fine collection for various city departments and processes public records requests as requested.
  • Work collaboratively with city departments to notice overdue citations and the recording of unpaid violations as liens annually.
  • Provide trainings to staff and enforcement officers as requested by issuing departments.
  • Performs other related duties as assigned.
Qualifications
  • Bachelor’s degree or 1-3 years of relevant, equivalent experience in municipal enforcement.
  • Master’s Degree, JD or equivalent recommended
  • Four plus years’ experience in working in municipal, state or federal environment preferred
  • *City residency required within six months of hire.
Knowledge, Ability and Skills
  • Knowledge of Mass General Law Ch. 40U.
  • Knowledge of local ordinances as they relate to Mass General Law Chapter 90 §20A.
  • Ability to become knowledgeable with local ordinances as they relate to parking enforcement, building enforcement, health department, care of animals, and any other department that interacts with the hearing officer.
  • Ability to issue clearly written and concise decisions.
  • Ability to make fair and impartial decisions.
  • Ability to maintain strict confidentiality with database and other information.
  • Ability to report and present to the Lynn City Council and other City, local, or community agencies if necessary.
  • Experience with appeals in Land Court, District Court and Superior Court preferred.
  • Ability to deal with the public in a responsible manner and behave ethically.
  • Working knowledge of Microsoft Office and other related computer software with a high level of proficiency in Microsoft Excel and PowerPoint. 
  • Highly detail oriented.
  • Strong critical thinking and decision-making skills.
  • Excellent listening skills.
  • Experience de-escalating difficult situations and interfacing with the general public recommended.
  • Conflict resolution and customer service training preferred.
